I like both scarves and can't pick a favorite.
I have worn same outfit two days in a row, not even with a minor change. I've done this when I have only worn the outfit for a few hours on the first day, and it's still fresh enough, plus I'm not going to be seeing the same people (which is, well, practically every day for me anyway). And I loved it so why not re-wear it?
As for what makes it a different outfit, I've been thinking about that quite a lot lately! For example, what if it's a basic wool black dress in simple silhouette? Does changing out just the scarf make it a "new" outfit? And I don't know if anyone here remembers the Uniform Project (1 dress worn 365 ways http://theuniformproject.com/year1/), but if you do, that makes me vote "yes." However I'd probably make at least one more tweak, such as swapping bags not just scarf, or different footwear/hose.
As for your two outfits there, what makes it look "same" not different enough is the sweater more than anything. That sweater is quite a statement, and rather memorable. The top/skirt/hose/footwear are more like a palette for the accessories/statement pieces/scarves to play -- the equivalent in my example above of the black dress. Does that make any sense?
