So I emailed La Garconne, explaining how the leather separated from the sole. They said they would not take them back because they've been worn and they're from Pre-Fall 2013 so they can't send them back to the designer. They suggested taking them to a local cobbler to get them fixed.

I think you should tell them again that the product was clearly defective and could not be used for its intended purpose (i.e. walking) because it separated from its sole. And you were injured because of it. So you are not returning a used product, but rather a defective product. Basically see if you can scare them a little

Interesting. I guess I won't be shopping at La Garconne. They sound snobby. As in, if it were from a more recent collection you'd have a more valid claim? Because you didn't pay full price maybe? This attitude reminds me of Barney's.

However, I disagree that you should threaten them with an injury claim, unless you actually have doctor's records proving such. Then you must be willing to go the distance with an injury lawyer, etc.

Are these the same clogs that were too small? Fix them if they are worth it to you (you could also consign them if they are fixed). And be done with them AND this retailer.

I'm with Cocolion on this one. Those shoes have brought you nothing but grief and time wasted

However, I would consider it time very well spent to outline everything in an online google or yelp review of La Garconne AND the shoes themselves.

This type of customer service is short-sighted, I don't expect that things will never go wrong. I do make note of how things are handled and believe in voting with your feet (and wallet).

You have rights, I would inform the company you're aware of your consumer rights and will approach the relevant agency if the issue is not resolved.

They sound like they are thinking they can pull the wool over your eyes and not deal with a defective product vs. just a whimsical return. Can you work your way up the food chain?

Sorry this happened to you. I can guarantee I would never shop there again.

I guess it depends on how upset you are and how much you want to dwell on it. It does seem rather ridiculous that the sole would separate after a wear or two. But again, you'd have to be angry enough to deal with it and escalate.

Wow, that makes my teeth hurt. Count another shopper out. Have you tried emailing the brand directly? When my leather jacket tore, the retailer would not help, but the designer made it right.

I've never had a problem with La Garconne. I find the level of anger about not taking a return surprising, ladies. La Garconne is a very good site that is not trying to scam anyone; AG bought these shoes at end of season at extreme markdown and LAG is very clear about things being final sale. So it's not out of line that they really are, as LaG says, final sale.

AG, try contacting the designer like Rae suggested, maybe you'll get them repaired. But the fact is, sometimes things are final sale and that's life. AG took a chance, it didn't pan out, she doesn't get a return... She tripped in the shoes and they ripped. It sucks but it's not La Garconne's fault.

Sorry IK. I believe that shoes should not rip after the second wearing. Also I do not know if the trip caused the rip or the rip caused the trip.

Yes, you don't know, and neither does LaG, and it was final sale. Caveat Emptor, especially where trendy fashion is sold on a seasonal basis. It's happened to me too - final sale Rag and Bone boots I couldn't even get my feet into because of the way the cuff was designed. Final Sale. My gamble. Not the retailer's fault, IMO. It certainly wouldn't make me never shop at LaG again.

Nordstrom is unique in taking returns no matter what. Most retailers simply can't do that.

This is crummy. There is a very real possibility that the shoes were defective, although like you say, you can't know for sure what caused what. So I think it would have made sense for the retailer to refund your money, despite it being final sale. Final sale does not apply to defective merchandise. So they shouldn't have said they can't take them back because they've been worn—that's not the issue.

I guess I would try LaG one more time and ask to speak with the manager if necessary, letting them know that this is about *defective* merchandise. If that doesn't work, I agree that taking it up with the designer would be a good idea.

I hope they make it clear when purchasing final sale that it means they won't refund you even if the product is defective. Based on online reviews sounds like you are not the first one to experience this with a product they sell. Shame on them for not standing by their merchandise; that's a pretty flimsy excuse.

Don't know the backstory on these shoes at all. Did the OP buy these on a Final Sale in the store or online?
Final Sale in store means you can inspect for any defects and flaw and know what you are getting and be aware.
Final Sale online means who knows what you are getting and you might be able to push them a bit.

An item has to be fit for purpose as far as I'm concerned regardless of the price. Scrapes to the leather would be expected from a fall but for the leather to seperate from the sole?
