I think this is a very complicated issue, rape is the most vitriolic of crimes and those guilty should rot behind bars for life in my opinion BUT we have to remember that a very small proportion of women do falsely accuse men of rape AND a man accused of rape is entitled to a defense.
In cases of date rape, where it amounts to his word against hers, all aspects of the night would have to be considered in determining if sex was consensual or not. The jeans may have been an indicator, yes as Angie has rightly said, skinny jeans only have to be pulled down slightly for a sexual attack to occur, but how easy would they be to fully remove if the man accused is physically lying on you?
I do not think a women's dress should be a consideration in rape cases and I DO STRONGLY BELIEVE THAT A WOMAN HAS THE RIGHT TO SAY NO TO SEX AT ANY TIME.
In fact my friends Sister Sharron was the victim of rape twenty years ago, she was slashed with a knife several times and is lucky to be alive today. I have witnessed how difficult it is for a victim to rebuild her life BUT in a society where an accused is entitled to a fair trial with a defense these issues will continue to be raised time and time again.
