&#060;p&#062;I agree that it's worth writing a note to the seller to make them aware of the flaw and ask for a discount, but check on their policy. It would not be cool of them to list something as NWOT without disclosing any flaws in the item, but it's possible they didn't notice the tear. (I doubt it, but I try to give benefit of the doubt.) &#060;/p&#062;
&#060;p&#062;eBay seems to be backing me up as a seller, but my situation was different. I had a recent experience with a buyer who bought a skirt from me -- they asked no questions ahead of time, and my policies clearly state no returns/no refunds. After the purchase, they contacted me and said the skirt didn't fit -- could they return it for a refund? I politely responded, no, that the listing indicated no returns. I even suggested that they might resell it, since it seemed to be fairly popular and got a number of bids. A week later, the skirt arrived in my mailbox with a note that they wanted a refund! I ended up filing a report with eBay in case they try to force me into a refund by giving me negative feedback, and I've heard nothing more from them. Sigh. Such a shame that there are bad sellers and bad buyers on eBay who can sometimes make it an unpleasant experience. I hope your seller does right by you.

It is more likely you will be offered a full return than a discount unless the seller happens to be particularly nice. On the other hand, I don't think you have anything to lose by asking.&#038;nbsp;

&#060;p&#062;Or, if you really love the jacket and most important -- the fit is not defective -- you can just live with it. &#038;nbsp;Especially if the seller listed the item &#034;as is&#034; and reflected the defects in the price (even without listing them all).&#060;/p&#062;
&#060;p&#062;There are individuals who are far more experience with eBay than I am so you might ask them (Rae, Mo come to mind).&#060;/p&#062;

&#060;p&#062;First, I found a biker jacket! I returned both the Theory options and instead bought a Theyskens Theory jacket off ebay. It's less classic and masculine than I'd been looking for, but I fell in love with it. It fits almost like a blazer and it has an interesting waist line. I'm wearing it with my new boyfriend jeans (AG, thrifted) and my favorite LD Tuttle shoes that I'm trying to wear more often. I realize the turtleneck makes it hard to see the jacket but I'm excited that it's finally cold enough for turtlenecks. Oh, and my hair is soaking wet - it's usually a lot poofier and brighter!&#060;/p&#062;
&#060;p&#062;Second, from a few days earlier, a solution to a funny clothing situation: I was down at my old apartment for a few days to do the final cleaning and pack up my last few items. I forgot to bring a change of clothes, but I'd just picked up a pile of drycleaning down there, so this was what came out of the drycleaning pile. Theory shorts (made from a pair of dress slacks), BR shirt (I don't love the tied front but it's sort of interesting), and the only shoes I had, my Madewell combat boots that I wear most days.&#060;/p&#062;
&#060;p&#062;And a question: the Theyskens jacket was described as &#034;new without tags&#034; on ebay&#038;nbsp;(always a risk) but I discovered that it was a second / reject / overstock / whatever when I received it. The label is marked through with a black line (not mentioned in the post), there's a big but unnoticeable&#038;nbsp;rip in the sleeve lining, one of the leather seams has a tiny imperceptible tear, and a snap is slightly broken. I want to keep it regardless, but should I ask the seller (a small volume individual seller) for a partial refund or discount? I've never bought clothing on ebay before.
