Jules - I suspect you're right. Even though it irks me, I'm going to pay it. There's just no way to bring it up without getting everyone all riled up. It's a very small building and everyone knows everyone's business. NYC coop boards are notorious for being a PITA.

I'm half expecting the attorney to send me a bill for asking her about the bill!

The coop wanted to review the POA before they would give you info that you were requesting? Then to my mind*, they pay the lawyer, or, inform you up front of their POA review fee. Very odd, and I'd be following up with them to ask why they didn't inform you up front that she would be charging you. Because I'm wondering if the billing dispute originated between them and the lawyer, so she tried to recoup via you. At the very least, by contacting the board you are doing the next person they refer to their lawyer a favour in that they might warn them!

*completely, ignorantly non-legal mind, to be clear

I'm not a lawyer either but based on my contract law course, in order to be binding, there are three required elements to a contract: offer, acceptance, and consideration. She did not make an offer for services and you did not accept the terms of the offer. I suspect she should know better.

I would have understood this if the coop board had asked to to contact "an" attorney, but if they asked you to contact "their" attorney, I might have assumed they had her on retainer and that she was reviewing their documents to smooth your dealings with the coop board. In other words, that she would bill them.

Not an attorney. I'm a voice teacher, but I always send prospective studio students two documents -- one with my studio prices and policies, and the other with my teaching approach. They can be informed consumers and I can feel good about receiving money in exchange for giving them something of value.

Is it accepted practice for an attorney to send a bill without first telling you 1) that they are going to be billing you for talking to them, and 2) telling you their rates?

Basically - as POA for my elderly dad, I contacted the board of the coop building where he lives to get some basic info for estate planning. They asked me first to send my POA to the coop's attorney so she could review it, we had a few brief emails back and forth, and that was that. At no time did either the coop board or the attorney tell me I would be charged for anything or what the rate would be.

When I received the bill I was surprised, and when I questioned the attorney in question, she basically said, "What do you think happens when you talk to an attorney." Of course, that made me feel like a total rube.

Is this a common practice? I'm just curious.
