				<description>&#060;p&#062;I had to open a case once because the seller sold me shoes that literally fell apart on my feet when i tried them on. They wanted me to ship them back ($10 shipping) and then they would refund. I didn't see a point in sweeping up pieces of shoe to put in a box but i told them i was more than willing to take pictures. They stopped responding. I opened a case and Ebay stepped in right away and refunded everything. &#060;/p&#062;
&#060;p&#062;Most sellers are super nice and accommodating, but don't let yourself be taken advantage by ones who are not!

				<description>&#060;p&#062;In any situation on ebay where you receive an item that has damage or is significantly not as described, always contact the seller.  And if you don't receive satisfaction there, it's just fine to open a case.&#060;/p&#062;
&#060;p&#062;I think the only times I've *ever* had any issues with someone wanting to return something was when they got it and didn't like it, and wanted to return it - despite my auction very clearly saying all sales are final.  It's one thing to get a wrong item, it's another to get it and blame the seller for you no longer wanting it!&#060;/p&#062;
&#060;p&#062;I have always refunded money if there was a flaw I didn't see.  In fact, in some cases where that happened, I simply refunded the money plus shipping and told the buyer to keep the item and donate it or whatever as it was my fault.  In other cases I have refunded money for repairs, if repairs were possible.&#060;/p&#062;

				<description>&#060;p&#062;Just contact the seller and let them know. They may just offer you a refund. Or they may ask you to ship it back. If so i would make sure you do not have to pay any shipping fees since this is their oversight.&#060;/p&#062;
&#060;p&#062;if they don't make it right you can open up a case with Ebay and Ebay usually steps in and gives you a full refund. But hopefully it won't come to that.

I wouldn't hesitate to contact the seller (people do miss things) most genuine sellers are happy to refund in these circumstances. I always make sure the tone of my message is really polite something like  - love the item but I noticed that.....I've had 2 sellers who reacted badly (in 800+ transactions) but eBay or PayPal sorted it out for me. Good luck.

I recently got a silk shirt with weird pre tears (very thin places on the fabric) that you could see light through but not apparent at quick glance.  It was listed as pre-worn, but also with the description of no rips, tears, holes.  Luckily the seller accepted returns and so I mailed it back today with no more than a 'this didn't work out for me, I'd like to return it'.  In the end, the shape of the shirt was way too boxy and I would have returned it on that merit alone.&#060;br /&#062;
Does your seller accept returns?  If it's not stated on the listing, I would definitely email regarding the splits.  Pre owned and damaged are not the same thing!

				<description>&#060;p&#062;Contact the seller and tell them what you told us, that there seems to be some damage to the product that may have happened during packaging or unpackaging, but that you were wondering what to do next now?  Let them take if from there.  My hubby has had good luck with Ebay sellers when using that approach.  &#060;/p&#062;
&#060;p&#062;Not accusatory, things can happen in the shipping process and that's not your fault or theirs, but the seller will often give a partial or full refund.&#060;/p&#062;
&#060;p&#062;I can easily see the damage you are talking about and if the blouse fell apart that easily (which I doubt) I wouldn't be happy either.

				<description>&#060;p&#062;I've had a similar dilemma recently and I still haven't figured out what to say.  I bought a pair of boots that were described as having been worn once, but when I got them the uppers are all cracked and peeling -- clearly worn out!  &#060;/p&#062;
&#060;p&#062;My problem is that I was a sucker and paid too much shipping while the actual item cost was very low, so I could file a &#034;not as described&#034; complaint but I'd only get a pound back. :-(&#060;/p&#062;
&#060;p&#062;I guess in your case I might just say &#034;hey, you might not have noticed it, but this blouse is ripped and not in wearable condition.  How do you want to resolve this?&#034;  and see what they say.  If it comes down to it you can file a complaint with eBay.

				<description>&#060;p&#062;I recently bought a blouse off Ebay that is made up of alternating strips of linen and really delicate, sheer silk. I received the item today and I noticed small splits in the sheer fabric in several places. They are tiny splits, but I can tell that they would get bigger with wear. None of these splits was described on the product page and I didn't see any damage in the product photos (I always try to look them over carefully). There is one tear, however, that is rather large, but I also can't see it in the product photo, and I wonder if I somehow created it when I took the blouse out of the package and tried it on (see photo #4)? But I can't imagine that I made four tears in the blouse just by trying it on. It's a button up style so I didn't have to pull it over my head or anything. &#060;/p&#062;
&#060;p&#062;Anyway, I think I want to contact the seller and return the blouse, but I don't want to sound accusatory because, like I said, these splits are fairly small (except for that one that may or may not have been there before I opened the package and tried on the blouse) and I'm not sure you can even see the tears unless you unbutton it and try it on. Also, I didn't spend a ton of money on the blouse, because I know Ebay is a risk and I don't buy anything on there that I would feel completely ripped off if the gamble didn't pay off.  &#060;/p&#062;
&#060;p&#062;For those of you who sell items on Ebay, what do you think I should do? I want to be fair, but I also would rather not be stuck with a blouse I can't really wear at all. If it were just one split, I would probably avoid the hassle and mend it, but there are just too many. What's the best way to contact the seller and what should I say, exactly? I've never had anything like this happen before because I've always had good luck with my Ebay purchases.&#060;/p&#062;
