&#060;p&#062;Sorry you are dealing with this (literal pain in the neck, isn't it?).  I am wondering if you might want to get a referral to an orthopedic surgeon/spine specialist first, as long as you are fighting the system anyway.  I am always worried whether a chiropractor in some cases may do more harm than good, and in my experience an orthopedic surgeon will usually have X-ray right in the office so at least they can tell whether you have any conditions that would make it unadvisable to see a chiropractor.&#060;/p&#062;
&#060;p&#062;I noticed that there is conflicting information online regarding whether a chiropractor or an orthopedic specialist would provide more help for whiplash.  I guess my personal preference would be to rule out any serious spine problems that could make it dangerous to see a chiropractor.  So perhaps getting a referral to both would be the best thing to ask for.

However it does sound like this situation calls for a lawyer's advice. Write everything down, write what the GP told you, better yet, ask him for an affidavit. If he tells you you need a treatment, get him to write it all down for you and sign. Get him to tell you again what he told you by writing. &#060;/p&#062;

				<description>&#060;p&#062;Sorry Rae!  Accidents are one of the things I don't miss about LA.  I had so many bad experiences, there were lots of uninsured motorists back when I lived there.   I tended to do nothing which is a big mistake.  I like Una's suggestion of getting an accident lawyer.  I used to think I didn't want to add to our litigious society so I avoided representation.  But all it got me was higher premiums and feeling taken advantage of.  Yes, my rates went sky high because I had uninsured coverage and three accidents I was in, involved uninsured people suing me when it was their fault in all three cases.  So, my point is, get a lawyer.

&#060;p&#062;If a patient came to see me regardless of what state I practiced in I would examine and treat the presenting complaint. The only exception is if someone already has a workman's compensation or insurance claim that is being handled by another physician/provider.&#060;/p&#062;
&#060;p&#062;Your physician has a moral, ethical and medicolegal obligation to treat you. Call your HMO. Call your claims adjuster. make a stink. call the media. blog about it.&#060;/p&#062;
&#060;p&#062;Livid on your behalf. And ashamed  on the behalf of my profession that the person you saw calls him/herself a physician.

GP needs to examine you before you see chiropractor, take exrays, etc, and refer you to specialist if needed. Unfortunately, most chiropractors are not covered by insurance( I have to pay out of pocket for my visits). Check with your insurance to make sure. I don't think you should delay your threatment until the insurance companies come through or whatever

&#060;p&#062;Vicki, I'm very sorry to hear about Mike's accident! I was able to make a *bit* of progress by making a high nuisance of myself this morning, but I may take you up on your offer if it gets more complicated. &#060;/p&#062;
&#060;p&#062;I talked with my health insurance provider, and she said what you've all said, which is that he should have provided care and that they would have then requested reimbursement from the car insurance provider. She helped me change my GP to another doctor who is just as close to my job. &#060;/p&#062;
&#060;p&#062;I was also able to speak with claims services and get more info. The most important thing was that he told me I do not need a referral for them to reimburse for a chiropractor. I still want to see a regular doc first, Rachy, but if I can't get an appointment ASAP, I have been suggested a good one that does a thorough exam before treatment. &#060;/p&#062;
&#060;p&#062;I was also told that one of the reasons for delay is the lack of response by the other cars involved. Since we were at a full stop, my car took most of the damage, so the other drivers are not so concerned. However, the responsible driver's ins. needs to contact them to see whether total damages are within her policy limit... if they are over, they have to reimburse me for my deductible &#038;amp; have my policy help pay.

				<description>&#060;p&#062;There must be other dr's in your health plan. I don't think this is someone I would want to visit for a health concern. And as someone who sat on employer side of things, I would have you call the health plan directly as most likely, they won't speak to a third party regarding a medical issue. I can't help much beyond that as we have always gone to an HMO that provides all the care and referrals. Most plans don't cover chiropractors though. Lodge a complaint with health care provider insurance plan about the dr. and maybe at some point they will remove him from preferred list. &#060;/p&#062;
&#060;p&#062;The one thing I would tell you is not to be pressured on accepting the low blue book from totalling your car - do a little research so you are prepared when insurance company gives you that proposal or you may not get replacement value on the car.

Here, in MA, if the health facility is non profit, it HAS to take you regardless of insurance or ability to pay.  If it is life threatening, every facility is required by law to take you regardless of profit category. Unfortunately that is not true of all states.  I wonder what the law is in CA.

				<description>&#060;p&#062;I smell a rat! My DH and I have had HMO coverage for years and yes, we have to get referrals for certain things. Still, my recent ER visit was covered. I had to get a referral from my PCP to go to the ortho clinic, but it was quick and easy to obtain. I'm sure I could have gone to the regular ER and my insurance would have covered it. I just chose to go to one of those walk-in urgent care places so I wouldn't have to wait for an eternity to be seen.&#060;/p&#062;
&#060;p&#062;Your insurance should pay for you to be examined, regardless of what coverage (or lack thereof) the other driver(s) involved in the accident had/have. Whether or not they'll pay for certain types of therapy will depend on what type of coverage you have, though I think they would pay for physical therapy. It's not like PT is an alternative therapy or whatever, ya know?&#060;/p&#062;
&#060;p&#062;Lastly, the doctor should have seen you anyway. I think it's wrong that he refused to look at you!

&#060;p&#062;Your doctor sounds off. Get another one. I wouldn't go to a chiropractor until you get actually examined by an actual doctor. You need to know what you're treating before you go get treatment. If you're walking around, we may be talking soft tissue injury or a spinal sprain. In which case, frankly, what you need to is lie down.&#060;/p&#062;

If your health insurance want to seek reimbursement from the other driver's vehicle insurance they will do that themselves.   Third party subrogation, blah blah.  &#060;/p&#062;
&#060;p&#062;Perhaps you need to see an attorney.  I have to say, a lot of people lose out by dealing with the insurance companies (both health and car) directly.  Often just a letter from a lawyer will be enough.  And the attorney will be paid out of what they recover for you so you don't have to pay anything out of pocket.  &#060;/p&#062;

It then sounds like your doctor missed the whole point, thinking that you'd be waiting on a car insurance settlement to cover the potential costs of treating your sore back. &#060;/p&#062;
&#060;p&#062;Confusing! Is there a way to get back into see the doctor and explain that you were told by your health insurance to see your regular doctor? That if there *is* any car insurance settlement, that this is sort of besides the point - that your health insurance co. instructed you to see your doctor in case you needed specialist treatment? &#060;/p&#062;
&#060;p&#062;Gee, I wouldn't want to go back to that doctor though...&#060;/p&#062;
&#060;p&#062;Maybe call health insurance again and ask what to do next? These types of things are best dealt with sooner rather than later - physiotherapy might help a whole lot, but I'm no doctor.&#060;br /&#062;
Could you also maybe talk to the receptionist at your doctor's office and explain what happened and that there's some confusion and you still need your back looked at by your regular doctor ASAP ? &#060;/p&#062;

				<description>&#060;p&#062;This is a crazy response from your GP and you were the one who was hit and not at fault here.  My hubs was rear-ended on the 405 two weeks ago, too, while stopped in traffic and the person who hit him wasn't driving attentively and crashed into him at a high rate of speed.  His back was hurting him and he was taken to the hospital in an ambulance, which was a wise move, on many counts.  The car is totaled (frame damage) and since it was not his fault, he is to send any medical (and other) bills to the other person's attorney.  I believe you have up to a year to file any claims or lawsuits connected with your accident and injuries, which could crop up later.&#060;/p&#062;
&#060;p&#062;It sounds like you are in a similar situation, where you need to do what's necessary to heal your body, repair or replace your car (remember, now, your car fax will show that your car was in an accident and its value will be affected and probably diminished by this report) and submit any charges to the individual's insurance company.  You should be entitled to a rental car, too, and any subsequent charges would be turned over to your insurance company and the person causing the accident.&#060;/p&#062;
&#060;p&#062;It's so unfortunate that you have to go through all of this and I hope you're doing okay.  Since you're going through the same thing, if you'd like to pm me, I can have Mike call you about what he went through and talk to you.  Hopefully, the legal minds here will be able to assist you as I don't have that background.&#060;/p&#062;
