				<description>&#060;p&#062;I need to clarify my previous statement. Patent is the incorrect word. CL trademarked his red soles, which means that as long as the company uses it, that trademark is FOREVER. A patent typically lasts 20 years, a copyright on written material is usually 50 years plus the original author's lifetime. But a trademark is potentially forever.&#060;/p&#062;
&#060;p&#062;This isn't the same as a company logo, IMO. This is a design feature of one item of apparel, which was done before Lululemon and continues to be done by other companies. Lululemon was never the origin of this idea or design. But by granting the company a trademark like that granted to CL, this design would be off the market FOREVER. Even Hermes hasn't done that. Chanel hasn't done that. LV hasn't done that. Top designers know that there will always be those willing to purchase their pieces, no matter how many copies and knock-offs there are. Most companies occasionally chase down an infringement, but it is extraordinarily rare for them to attempt to trademark a design. I think these cases set a dangerous precedent.

				<description>&#060;p&#062;I love my Lululemon Pants....for yoga and workouts.  I've worn them at least a hundred times and washed them as often.  For me, these are definitely gear.  And I'd probably never buy a &#034;fashion&#034; version - I don't think they'd hold up to the frequent washings and the stink I can generate :).&#060;/p&#062;
&#060;p&#062;I think Lululemon makes a good product and has the right to protect it, but their whole self-righteous company ethos gets on my nerves.

				<description>&#060;p&#062;It IS a knock-off economy, and everyone copies someone. Target carries shoes that are identical to Born (or they used to - and what a brand to copy!), there are truly fake (label and everything) bags on every corner, and ALL stores carry some version of what was seen on runways (colours, styles, hem lengths, etc.). Realistically, why would Target be selling mico-mini skirts and bell bottoms if the trend is midis and skinny legs, KWIM?&#060;/p&#062;
&#060;p&#062;But patent laws can be insane. Christian Louboutin was successfully able to patent red soles, despite the fact that designers had done it before him, and despite the fact that it could be considered an essential design element for some shoes (say, an all-red shoe). But patenting a colour and a location? Please. Ridiculous.&#060;/p&#062;
&#060;p&#062;I agree with Mo that I was puzzled by the overlapping bands of different colours on yoga pants years ago, and I had never heard to Lululemon before. Their company certainly didn't originate the idea. I hope people come to their senses and don't allow this lawsuit to win. I understand protecting intellectual property, but this was not an idea original to Lululemon. MOST fashions aren't originated by any modern designer because there are only so many ways one can put fabric and colour on a body. It has ALL been done before.

				<description>&#060;p&#062;Hmm... I think they should be able to protect their design...for a year.  After that, it can be a free for all.  I don't think people should be able to lock up designs forever but I think you should get a period of exclusivity.&#060;/p&#062;
&#060;p&#062;The lululemon pants look higher quality - better stitching and fabric, which justifies the higher price.  If they aren't higher quality, then they should lower their prices to match CK.&#060;/p&#062;
&#060;p&#062;I'm always willing to pay for a higher quality or original &#034;X&#034; if I can afford it.  If I can't, that company wasn't going to get my business anyway, even if I buy the less expensive version.

&#060;p&#062;Somewhat OT, but I just found out yesterday that apparently there is a huge issue in Canada with fair use/copyright laws.  Something happened (not sure yet what) so that professors can no longer use images for teaching without paying copyright owners, and this is causing all sorts of problems.
