Yes, yes re OPA and advance directive and making sure that it will be recognized in both states. I don't know whether being registered domestic partners (or not) makes any difference in California. . .But you should make sure that anything you execute in one state will also be recognized in the other. Unless you take action, neither of you will be regarded as next of kin and a lot of pressure and responsibility will be put on your respective mothers which neither they nor y'all probably want.

MaryK brings up a good point. I would worry less about your will than I would about arrangements should one of you get sick or incapacitated. These are emotional, scary times and a properly legal piece of paper can make your wishes a lot easier to fulfill.

Definitely see a lawyer. There are tax issues you might need to consider as well as survivorship matters--and different states have different inheritance laws. There are other ways to hold property besides joint tenancy and you need someone who knows the laws of the states where you hold property. Make certain you both have an advance directive and power of attorney for health care. You might also consider a living trust.

Unfortunately, some families can act in unexpected ways when one of their own dies--it is best get everything settled and tied up before something serious comes along.

I think that's a really good reason to go to a lawyer -- living in two states is a complication that, in my view, makes your situation unsuitable for a fill-in-the-blanks, one-size-fits-all, solution.

Thanks Mary! I do wonder if living in both states is an issue, too. I have held on to my CA license and BF has held on to his FL one - all these years lol.

Many states (California included) have what they call a "statutory will," which is a form you can fill out yourself. It looks like Florida does not: http://www.floridabar.org/tfb/.....5d085256b2. Me personally, I would hire an actual lawyer. It's not that expensive and the peace of mind would be worth it to me.

Coming back to say as important as wills are advance health care directives and powers of attorney for health care and other matters, in the event one of you becomes incapacitated.

I don't know the answer, Una, but my DH and I are asking the same questions. We're also checking into our financial assets -- trying to make sure funds would be available if something happened to one of us.

Will a document site like Legal Zoom be good enough for an uncontested will? For instance, the BF and I are life partners, and both our families know and acknowledge this. No one is going to stand up and say, they are nobody, the stuff belongs 'in the family', etc. Anyway, even assuming if someone did - would an online will be good enough to stand up in court? We have a condo (paid for), its contents, small savings, and (paid off) cars. No children. Pretty cut and dry really - the stuff goes to the life partner and if they don't survive, our respective mothers (no dads left alive). Or do I/we need to get an actual probate lawyer and draw one up?
