I am no copyright expert and am mostly familiar with U.S. law, but from my work in both U.S. commercial and educational contexts I do know that you do not have to register with the Copyright Office to assert your copyrights. I believe doing so gives you a stronger case if you claim copyright infringement, however. Also in the U.S., fair use allows for certain uses of copyrighted work without permission from the owner--usually for educational purposes or for satire or analysis. Other uses might be vulnerable to legal challenge, but the risk might be small.

This is off topic so I'll stop, but the legal issues around using an image found online are often far from simple. You do have rights if your image is used without permission, but it is often hard to exercise those rights.

I don't use ebay, but I was thinking that aside from the ownership of the pictures, that by using a picture that's not their own, that basically the item would not be as described. That would fraud, I believe.

Thanks, Elizabeth. :) When my daughter sent me the email with links to various articles including pictures of her and her friends I was shocked. It was a real eye opener. It's not that long ago that we were all using fake names on the internet and being taught to be super careful. We've gotten very lax over the years.....especially with social media. Every time something terrible happens to someone their Facebook pics are ripped by the media.

"Actually ... images that you take ARE copyrighted, by the photographer."

True. But unless they are legally copyrighted through the copyright office they can be used by anyone as long as they credit you with it. It's an invasion of privacy but not illegal. Ebay will probably remove Angie's pic if reported since she was not credited. However, her head is cropped out so really, only people who know Angie would even recognize it.

"According to the Berne Convention (which I recommend reading so you better understand what it really covers and how it legally protects you), as soon as you press down the shutter on your camera you own the
image that creates. The copyright is automatic and instantly yours. You own the copyright of that photograph for a minimum of 25 years (duration of copyright depends on the medium). It does also state that people can use your work as long as they credit you with it."

A good read about watermarking and legally copyrighting. Watermarking is a great way to dissuade people from using your pics. Copyrighting is more for pros.
http://www.steves-digicams.com.....raphs.html

Angie, right above the "Item Description" box, on the right side of the screen, is a link called "Report item". If you click on this, it will take you to a page with a series of dropdown items. One of those items is for the infringement of intellectual property rights. It looks like it eventually leads you to a link where you can give a detailed report.

I don't know if this link will work, because I am signed in on my own account, but you can try it.

This is actually legal unless a photo is copyrighted. It happens more often than you might think. Those of you who post photos online might be surprised about where they end up. At least the Ebay user cropped out Angie's face.

My daughter's friend Wendel was googling himself one day and came across a whole bunch of online articles that included pictures taken from his Flickr page. Articles for termite control, family dining, mental health, etc. that included pictures of her friends.
This article about Seinfeld includes a picture of my daughter posing at the "Soup Nazi's" restaurant on their trip to New York. If you scroll to the bottom of the article the author actually credited Wendel for the photo. If you click on the photo it actually takes you to Wendel's Flickr page.
http://salvadorfigueros.com/co.....-clientes/
